Abstract

The article in question aims to weave an analysis about the theory of the approach of capabilities for human development in the perception of Amartya Sen. Throughout the work, it will be inferred that the development of a society is linked to the idea of freedom. Development arises when the expansion of the capacity of individuals is guaranteed, in other words: the right to be able to be what one wants to be or do, in accordance with the fundamental rights of human beings. The research method used will be bibliographic, based on material already prepared, composed of books, scientific articles, legal decisions and journalistic materials. Through the bibliographic source, it is sought, in an exploratory way, to analyze different positions on a problem, it is emphasized that the journalistic articles bring the theme to the present and allow a realistic look at the factual scenario, while the other contents will serve as a basis for philosophical discussion and arguments.

Graduated in Law from the Federal Rural University of Rio de Janeiro; Master in Administrative Justice from the Fluminense Federal University; Specialist in Administrative Law and Anti-Corruption Law, Specialist in Family and Succession Law. Researcher at the Laboratory of Studies on Conflict, Citizenship and Public Security (Laesp/UFF). Lawyer.
