The denial of legal rights and the prostitute woman: a case study from the Jury Court of Rio de Janeiro

Abstract

This is an article that analyzes the difficulty for the Judiciary and the Public Prosecutor's Office to identify non-intimate feminicides. The research is a qualitative analysis based on the epistemology of feminist critical criminology regarding the treatment given to the victim L.L.D.R., who was a victim of feminicide, where the violence perpetrated against her is clearly an act of misogyny and contempt for her condition as a woman, as required by Brazilian law. However, the crime was categorized as qualified homicide. What can be concluded from this interpretation by the Public Prosecutor's Office and the Judiciary is, beyond the absence of a gender perspective in the trial in question, the underreporting of feminicides that should be interpreted as such and are summarily ignored.
