A curatela sob medida: notas interdisciplinares sobre o estatuto da pessoa com deficiência e o novo CPC

In Brazil, the proposal to flexibilize curatorship for those suffering from mental disorders was carried out by doctrine, initially, through the constitutional interpretation of article 1772 of the Civil Code /2002, from 2009. Recently, however, per force of acceptance of the International Convention of Persons with Disability (2007), which rose in status from constitutional standards, there appear works suggesting the reading of this institute as from this international law, which deals, among other themes,
with civil incapacity. In 2015, two laws were published bringing changes to the theme: the Disabled Person Statue and the New Code of Civil Procedure. Thus, positing new thoughts on this theme is a subject of extreme modernity and social relevance. The proposal of this work is breaching the legal evolution of curatorship, by acknowledging the positive and negative aspects which gravitate around the theme.
